Chammy — Terms of Service

These Terms of Service (the "Terms") are a legally binding agreement between you and Bhudiskul Amphansang, an individual entrepreneur based in Thailand operating the Service under the name "Chammy" ("Chammy", "we", "us", "our"), governing your use of the Chammy mobile application and its related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Community Guidelines, which are incorporated into these Terms. If you do not agree, do not use the Service.
1. What Chammy is
Chammy is a personal styling app. You upload photos of yourself and your clothes; the app uses automated software, including machine-learning models, to create virtual try-on images, styled "looks," sticker cards, and outfit scores, and offers curated style templates ("Skins") and related features. The Service is provided for personal, non-commercial entertainment and styling-inspiration purposes.
2. Eligibility and age requirement
You must be at least 13 years old to create an account and use the Service. If you are under the age of majority where you live (20 in Thailand), you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
Body-photo features are for adults only. Uploading body photos — and every feature built on them (styled looks, virtual try-on, sticker-card cutouts of you) — requires that you are at least 18 years old and have reached the age of majority where you live (20 in Thailand), and that you confirm this in the app before your first upload. Users aged 13–17 may use the features that do not involve body photos (such as the wardrobe and garment tools).
We may suspend or delete accounts we reasonably believe belong to ineligible users, and we remove body photos we reasonably believe depict a person under 18.
3. Your account
- You sign in with a supported third-party provider (Google, Facebook, or Apple). You are responsible for the security of that provider account and your device; anyone who signs in through them can access your Chammy account.
- The information you provide (through your sign-in provider) must be accurate and yours.
- You may not sell, transfer, or share your account, or access another person's account without permission.
- You can stop using the Service and delete your account at any time in the app (Account → Delete account) or via https://chammy.cloud/legal/account-deletion.
4. Your content
4.1 What "Your Content" means
"Your Content" is everything you upload or create in the Service: body photos, garment photos, looks, try-on previews, sticker cards, sets, notes, and custom skins, together with data derived from them for your use of the Service.
4.2 You own it
You retain all ownership rights in Your Content. We do not claim ownership of your photos or creations.
4.3 The license you give us
So that the Service can function, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and technically process Your Content solely to operate, provide, secure, and improve the Service for you — for example, removing photo backgrounds, detecting garment attributes, rendering try-on images, and displaying your looks back to you. This license does not permit us to sell Your Content, publish it, use it in advertising, or use it to train machine-learning models, and it ends when you delete the content or your account (except for short-lived backup copies described in the Privacy Policy and content we must retain by law).
4.4 Your responsibilities for Your Content
You represent and warrant that:
- Body photos you upload are photos of yourself, and you meet the adults-only requirement in Section 2. A photo of any other person may be uploaded only if that person is an adult who has given you clear permission. You must never upload photos of anyone under 18.
- You own or have the rights needed to upload Your Content, and it does not infringe anyone's intellectual property, privacy, or other rights.
- Your Content complies with these Terms, the Community Guidelines, and applicable law, including Thai law.
4.5 Prohibited content and conduct — zero tolerance
We maintain zero tolerance for objectionable content and abusive behavior. You must not upload, create, or share through the Service any content that is unlawful, sexually explicit, exploits or endangers minors, is hateful, harassing, threatening, or violent, promotes illegal activity, infringes others' rights, or contains malware. You must not:
- reverse engineer, decompile, or tamper with the Service, probe or breach its security, or access it by automated means (bots, scrapers) without our written permission;
- circumvent rate limits or upload restrictions, or interfere with other users' use of the Service;
- misrepresent AI-generated try-on images as real photographs where doing so is deceptive or harmful, or use outputs to impersonate, defame, or harass anyone;
- use the Service to develop a competing dataset or service.
4.6 Moderation and enforcement
We may review, filter, restrict, remove, or refuse any content that we reasonably believe violates these Terms or the Community Guidelines, and we may suspend or permanently terminate accounts of violators — immediately and without prior notice for serious violations. You can report objectionable content or behavior at support@chammy.cloud (and, when available, via in-app reporting); we review reports promptly and aim to act on verified violations within 24 hours where the content endangers safety.
4.7 Copyright complaints
If you believe content in the Service infringes your copyright, notify us at support@chammy.cloud with: (a) identification of the work, (b) the material complained of, (c) your contact details, (d) a good-faith statement that the use is unauthorized, and (e) a statement, under penalty of perjury where applicable, that your notice is accurate and you are the rights holder or authorized to act. We will remove or disable access to infringing material where appropriate and may terminate repeat infringers.
4.8 Share links
The Service may let you publish a copy of a Set's card images to a web page hosted by us and share its link ("share link"). If you use this feature:
- You choose to publish. Creating a share link makes the selected card images viewable by anyone who has the link. You are responsible for who you give the link to, and you accept that recipients may forward it to others.
- The same content rules apply. Everything on a shared page is Your Content and must comply with Sections 4.4 and 4.5 and the Community Guidelines. Do not share pages containing another person's image without their permission.
- The license in 4.3 extends to hosting and displaying the image copies on the shared page for as long as the link exists — and ends when you remove the link.
- Snapshot. A shared page shows copies made at the moment of sharing; later edits to your set do not update it.
- Removal. You can remove a share link at any time in the app, which deletes the page and its copies immediately. We may also remove or disable a shared page that we reasonably believe violates these Terms or the Community Guidelines (Section 4.6), and anyone can report a shared page via the report link on the page itself or at support@chammy.cloud.
5. AI-generated content and scores
Try-on images, cutouts, and styled looks are generated by automated AI models and are approximations. They may contain artifacts and may not accurately represent how a garment truly fits, drapes, or appears in real life. Outfit scores and rankings are automated opinions for entertainment and inspiration — not professional, commercial, or factual claims. You are responsible for how you use and share generated images once you export them from the app.
6. Our intellectual property
The Service — including the app, backend software, design, branding, the Chammy name and logo, the curated Skin catalog, artwork, backdrops, stickers, and announcement content — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial use, in accordance with these Terms and the app-store rules under which you obtained it. All rights not expressly granted are reserved. Feedback you send us may be used without obligation to you.
7. Third-party services, links, and sponsored content
Sign-in is provided by third parties (Google, Facebook, Apple) under their own terms. The app may show links leaving the Service — for example, a garment's external shop page or a link inside an announcement. We do not control and are not responsible for third-party sites, services, or purchases made on them.
Affiliate links. Some shop links in the Service are affiliate links: if you open one and make a purchase from the merchant, we may earn a commission at no additional cost to you. This does not affect the price you pay, and we do not send the merchant your identity or your Chammy data. Purchases are made from the merchant under the merchant's own terms; we are not a party to that transaction.
Sponsored content. Some content in the Service — announcements, Skins, backdrops, or suggested garments — may be provided under commercial partnerships. Sponsored content is labeled (for example "Ad" or "Sponsored"). Sponsorship does not change how your own outfits are scored, and sponsors receive only aggregated, anonymous performance statistics as described in the Privacy Policy.
8. Fees and how the Service is funded
The Service is currently free of charge. We fund it through clearly labeled sponsored content and affiliate commissions on shop links (see Section 7) and through aggregated, anonymized trend insights as described in the Privacy Policy — never by selling personal data. If we introduce paid features, we will present their price and terms clearly before you commit, and purchases will be processed by the Apple App Store or Google Play under their payment terms.
9. Availability, changes, and termination
- The Service is provided on an evolving basis: we may add, change, or remove features, and we may suspend the Service for maintenance, security, or operational reasons.
- We may terminate or suspend your access (with or without notice) if you materially or repeatedly violate these Terms, if required by law, or if we discontinue the Service. Where practicable we will give you reasonable advance notice and an opportunity to export your creations.
- We are not liable for delay or failure to perform caused by events beyond our reasonable control (including outages of hosting or sign-in providers, network failures, acts of authorities, or force majeure); we will restore the Service as soon as reasonably practicable.
- You may terminate at any time by deleting your account. Sections that by their nature should survive (4.3's post-deletion tail, 5, 6, 10–14) survive termination.
10. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that AI outputs will be accurate. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law, including Thai consumer-protection law.
11. Limitation of liability
To the maximum extent permitted by applicable law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from or related to the Service; and (b) our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or THB 2,000. These limits do not apply to liability that cannot be limited under applicable law, including liability for willful misconduct or gross negligence under Thai law.
12. Indemnity
You will indemnify and hold us harmless from claims, damages, and reasonable expenses (including legal fees) arising from Your Content, your violation of these Terms, or your violation of any law or third-party right — except to the extent caused by our own breach of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law rules. Disputes will be submitted to the competent courts of Thailand, provided that if you are a consumer residing elsewhere, you retain any protection and forum rights granted by the mandatory laws of your country of residence. We both agree to attempt good-faith informal resolution via support@chammy.cloud before filing any claim.
14. App-store terms
14.1 Apple App Store
If you obtained the app from the Apple App Store: (a) these Terms are between you and us only, not Apple; Apple is not responsible for the app or its content; (b) the license granted is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service (including Family Sharing rules); (c) Apple has no obligation to provide maintenance or support; (d) in the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation; (e) Apple is not responsible for addressing claims relating to the app, including product-liability, regulatory, or consumer-protection claims, or claims that the app infringes third-party intellectual-property rights; (f) you represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties; and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14.2 Google Play
If you obtained the app from Google Play, your use must also comply with the Google Play Terms of Service. These Terms are between you and us only; Google is not responsible for the app or these Terms.
15. Changes to these Terms
We may revise these Terms. For material changes we will give you reasonable advance notice in the app; continued use after the change takes effect constitutes acceptance. If you do not agree to a change, stop using the Service and delete your account before the change takes effect.
16. General
If any provision of these Terms is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets (including a transfer of the Service to a company we establish), with notice to you. Nothing in these Terms creates a partnership, employment, or agency relationship between you and us. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and us regarding the Service. These Terms are drawn up in English; a Thai translation may be provided for convenience — if there is any inconsistency between the two, the English version prevails.
